Below you will find the terms and conditions of Wintersport4ALL.
GENERAL CONDITIONS - Winter Sports4ALL
These are our general terms and conditions. These, together with the references they contain, apply to every agreement that we, Wintersport4ALL, conclude with you. If you have any questions, please do not hesitate to contact us at [email protected] or by post: Wintersport4ALL, Xenonstraat, 1362 GD in Almere, the Netherlands. We have the right to change these general terms and conditions. You agree that the latest version of these general terms and conditions will always apply to our agreement.
Article 1 - Products
We sell Extreme Skiing Articles - Snowmobile, Snowbike, Skibike, Skibock.
Article 2 - Payments
The (total) price of the products is stated in our webshop. You can pay in our webshop with iDEAL and Direct Bank Transfer.
The shipping costs are for your account.
Article 3 - Deliveries
We deliver your product to the address you provided with the order. You can not change the address if we have already sent the package. PostNL and DPD provide the distribution. Once the package has been shipped, you will receive a Track & Trace Code, which will allow you to follow the order. We will do our best to deliver the order as quickly as possible. If the order is delayed, we will inform you in writing. We guarantee that you will receive the order within 30 days of confirmation of the order. If this does not work out unexpectedly, you can request us to (a) immediately refund the amount you paid for the product, or (b) send a replacement product (of equal value).
Article 4 - Return
You may always return the product within 14 days after you have received it. You can do this with the return form or by sending an email to [email protected]. After you have received confirmation from us, you must send the product within 14 days. Once we have received the product, we will refund the full purchase amount within 14 days. The costs for return shipping are at your expense. During the period you have to decide whether you want to keep the product, you must handle the product and its packaging with care. You may only unpack the product and inspect it to determine whether you want to keep the product. Products with damage such as dents, scratches or signs of wear will not be returned. Please note that items produced according to the customer's choice cannot be returned. Items with a hygiene seal cannot be returned if the hygiene seal is not completely intact.
Article 5 - Liability
We are not liable for the damage caused by the use of a product. This does not apply if such damage is caused by our intentions, gross negligence or conscious recklessness. Your right to compensation will in any case be the maximum amount of the ordered and paid product. We are also not liable for bodily damage caused by incorrect or use of the items on the slopes or indoor skis. Additionally, we are not responsible for the use of the articles during jumps, tricks, fallouts, off-piste, unprepared slopes or improper use of the articles etc. At times of filing a complaint, the article will always be considered used.
Article 6 - Intellectual Property Rights
All intellectual property rights (such as: copyrights, figurative marks, word marks) on our texts, photos, images and other materials are our property (or we are in charge with the consent of the proprietor). Your use should not be infringed.
Article 7 - Complaints
If you have a complaint about the performance of the agreement, we would like to hear that. Then send your complaint as soon as possible (and as fully as possible) to [email protected]. We will process your complaint as soon as possible, within 5 days of receiving your complaint. If it takes longer to settle your complaint, you will receive a confirmation of your complaint within 2-3 days and let us know when we expect a substantive response. If we can not resolve the complaint, a dispute arises under the dispute settlement.
Article 8 - Dispute settlement
On these terms and conditions and the agreements we conclude with you, Dutch law applies. In the event of a dispute, the court in Amsterdam is authorized.
